Secret Documents Unavailable to Indian Accused

The Economic Times reports:

Opinions and findings of the Court of Inquiry (CoI) into Sukna land scam in which several Generals were allegedly involved can be withheld from disclosure, the Central Information Commission has held.

The CIC was hearing an appeal by Lt Gen (Retd) Avadhesh Prakash, one of the accused in the case, who was refused information by the Army saying that disclosure would adversely affect the probe and prosecution in the case.

Prakash, who was found guilty by the CoI which recommended his court martial, through an RTI application in February, 2010 had sought to know opinions and findings of the CoI and remarks of Army Commander Eastern Command and all senior officers at Army HQ who endorsed the case file.
